This Privacy Policy explains how CALiNGA On-Demand Care LLC (“CALiNGA,” “we,” “us,” or “our”) collects, uses, discloses, retains, and protects personal information when you access or use CALiNGA Pro, CALiNGA Seeker, CALiNGA websites, backend systems, communications, payment functionality, care-report functionality, location-enabled features, and related technologies. This Privacy Policy should be read together with the CALiNGA Terms of Service.

01 Scope of This Privacy Policy

This Privacy Policy applies to CareSeekers, CALiNGApros, website visitors, account holders, care recipients whose information is appropriately provided through the Platform, authorized representatives, and other individuals interacting with CALiNGA. It applies to personal information collected through CALiNGA Pro, CALiNGA Seeker, CALiNGA websites, backend systems, communications, payments, care-report functionality, location-enabled features, and related technologies. It generally does not apply to lawfully de-identified or aggregated data. Additional rights may apply depending on jurisdiction.

02 Relationship to the Terms of Service

The CALiNGA Terms of Service govern use of the Platform. This Privacy Policy explains how personal information associated with matching, booking, the CALiNGA Digital Handshake™, clock-in/out, geofencing, hourly care reports, photos and attachments, payments, background screening, ratings, reviews, safety, and account functions is handled.

03 Categories of Individuals

CALiNGA may process information concerning CareSeekers, CALiNGApros, care recipients, authorized representatives, website visitors, and other users.

04 Information You Provide

CALiNGA may collect account information such as name, email, phone, date of birth, mailing address, profile photo, account identifiers and preferences; identity and verification information such as government ID, selfies, verification results, licenses and certifications; and professional information such as experience, credentials, CPR/TB documentation, training, languages, skills, and qualifications.

05 Care and Service Information

CareSeekers may provide requested care type, mobility information, assistance requirements, schedules, service location, language and accessibility preferences, care instructions, health-related circumstances, medication-related information, emergency-related information, and other information relevant to requested services. Users should provide only information reasonably necessary for the service.

06 Information About Care Recipients Provided by Others

A CareSeeker may arrange services for another individual. CALiNGA may therefore receive information about a care recipient who does not personally maintain the account. The CareSeeker or authorized representative is responsible for appropriate authority or permission to provide the information.

07 Sensitive and Health-Related Information

Some information may be sensitive, including physical limitations, mobility, disability/accessibility needs, health-related circumstances, care requirements, medication-related instructions, service observations, and care reports. CALiNGA processes such information for legitimate purposes described in this Policy and subject to applicable law and does not use sensitive care information merely for unrelated advertising purposes.

08 HIPAA and Health Information

CALiNGA is a technology-based marketplace and does not represent that every item of health-related information submitted through the Platform is protected health information under HIPAA. Whether HIPAA applies depends on the entities, information, transactions, and circumstances involved. CALiNGA nevertheless seeks to protect sensitive care-related information through appropriate privacy and security practices and applicable law. Users independently subject to professional confidentiality or healthcare privacy obligations remain responsible for compliance.

09 Hourly Care Reports

CALiNGA may collect and store timestamps, care activities, service observations, notes, assistance provided, service updates, care-related communications, photos or attachments where enabled, and related documentation. Reports may be shared with the appropriate CareSeeker or authorized user and may also be used for safety, support, payment disputes, fraud prevention, Platform integrity, and legal compliance.

10 Photos and Attachments

The Platform may allow users to upload authorized photographs, documents, notes, or other attachments. Users are responsible for obtaining required permission or authorization. CALiNGA may process such materials for care-report functionality, support, disputes, safety, fraud prevention, and legal compliance.

11 Location Information

Depending on device settings, permissions, features, and law, CALiNGA may collect approximate or precise location to display nearby opportunities or CALiNGApros, facilitate matching, verify service locations, support clock-in/out and geofencing, enhance safety, prevent fraud, investigate disputes, and protect Platform integrity.

12 Geofencing and Clock-In/Clock-Out Data

CALiNGA may process precise or approximate device location in connection with a confirmed service and associate it with the scheduled service location, scheduled times, clock-in/out timestamps, account information, booking information, and related records for service verification, payments, safety, fraud prevention, support, and dispute resolution.

13 Booking and Transaction Information

CALiNGA may collect service requests, accepted or declined requests, service categories, matches, Digital Handshake confirmations, dates and times, service locations, rates, pricing calculations, cancellations, refunds, tips, payment status, and transaction history.

14 Payment and Payout Information

Payments may be processed through Stripe Connect or another authorized payment provider. CALiNGA may receive payment status, tokens, transaction identifiers, receipts, payout status, refunds, chargebacks, fraud indicators, and limited payment-related information. Payment providers may directly collect financial information under their own privacy policies. CALiNGApros may provide information necessary for tax and payout purposes.

15 Background Screening and Identity Verification

Where offered, CALiNGA may facilitate identity verification or third-party background screening and may receive limited information necessary for verification or marketplace eligibility, subject to applicable law. A completed screening does not guarantee character, future conduct, qualifications, or suitability.

16 Live Scan and Fingerprint Information

Where permitted, a CALiNGApro may provide documentation showing completion of a fingerprint-based or Live Scan screening. CALiNGA does not collect or store the underlying fingerprint biometric data merely because proof of a completed screening is provided.

17 Ratings, Reviews and User Content

CALiNGA may collect ratings, reviews, profile content, messages, surveys, feedback, care reports, uploaded documents, photographs, support communications, and other user-submitted content. Some content may be visible to another user where necessary for Platform functionality.

18 Communications Information

CALiNGA may process in-app messages, communication timestamps, support requests, email communications, SMS records, notification status, and related metadata for operations, support, safety, disputes, fraud prevention, and legal compliance.

19 Device and Technical Information

CALiNGA may automatically collect IP address, device type, operating system, app version, browser information, device identifiers, language, crash reports, diagnostics, login activity, and security events.

20 Usage Information

CALiNGA may collect pages or screens viewed, features used, searches, bookings, referral activity, interactions, timestamps, navigation patterns, and Platform performance information.

21 Cookies, SDKs and Similar Technologies

CALiNGA may use cookies, SDKs, pixels, tags, local storage, and similar technologies for authentication, security, core functionality, analytics, performance measurement, crash analysis, preferences, and user experience. Where required, CALiNGA will provide appropriate choices or consent mechanisms.

22 Information From Third Parties

CALiNGA may receive information from identity-verification providers, background-screening providers, payment processors, fraud-prevention services, communications and OTP providers, mapping/location providers, analytics providers, cloud providers, professional or government sources where permitted, and other users who appropriately provide care-recipient or service information.

23 How CALiNGA Uses Personal Information

CALiNGA may use personal information to create and maintain accounts; operate the Platform; facilitate matching and bookings; document Digital Handshakes; enable communications; verify identity and credentials; facilitate screening; process payments/payouts; calculate pricing; support clock-in/out and geofencing; provide hourly reports; facilitate ratings/reviews; support users; improve performance; maintain security; prevent fraud; investigate safety incidents; resolve disputes; comply with legal/tax obligations; enforce policies; communicate updates; and protect CALiNGA, users, and others.

24 Matching, Pricing and Automated Processing

CALiNGA technology may process information to support matching, displaying opportunities, availability, pricing, suspicious-activity detection, security-risk identification, and Platform operations. Where applicable law provides rights concerning certain automated decisions producing legal or similarly significant effects, CALiNGA will provide applicable rights and disclosures.

25 Sharing Between Users

CALiNGA may share information between CareSeekers and CALiNGApros when reasonably necessary to facilitate services, including name, profile photo, rating, relevant qualifications, credential status, requested service, scheduled date/time, service location, care instructions, booking information, care reports, and other information reasonably necessary for the engagement.

26 Service Providers

CALiNGA may disclose information to providers supporting cloud hosting, payment processing, tax reporting, identity verification, background screening, mapping/geolocation, communications, OTP verification, email, analytics, cybersecurity, fraud prevention, customer support, and professional services, subject to contractual requirements and applicable law.

28 Business Transfers

Information may be disclosed or transferred in connection with an actual or proposed merger, acquisition, financing, restructuring, bankruptcy, asset sale, or similar transaction, with appropriate protections as required by law.

29 Sale, Sharing and Targeted Advertising

CALiNGA does not sell personal information for monetary payment. CALiNGA does not use sensitive care or health-related information for unrelated targeted advertising. Because some privacy laws define sale, sharing, or targeted advertising broadly, CALiNGA will provide required notices and opt-out mechanisms if it engages in activities legally falling within those definitions.

30 Data Retention

CALiNGA retains personal information for periods reasonably necessary for the purposes described in this Policy. Retention may depend on account status, information type, transactions, payment/tax obligations, credential requirements, fraud prevention, safety investigations, disputes, legal claims, regulatory requirements, and statutes of limitation. CALiNGA may retain information after account deletion where permitted or required and may delete, de-identify, or securely dispose of information when no longer reasonably necessary.

31 Account Deletion

Users may request account deletion through available Platform functionality or by contacting CALiNGA. Deletion does not necessarily result in immediate deletion of every record; CALiNGA may retain information for legal compliance, tax/financial reporting, fraud prevention, safety, disputes, chargebacks, enforcement, legal claims, or other legitimate purposes permitted by law.

32 Data Security

CALiNGA uses reasonable administrative, technical, and organizational safeguards designed to protect personal information, which may include access controls, authentication, encryption where appropriate, security monitoring, and restricted access. No electronic system can be guaranteed completely secure. Users are responsible for protecting account credentials and devices.

33 State Privacy Rights

Depending on residence and applicable law, individuals may have rights to know/access information, obtain copies, correct inaccuracies, delete certain information, obtain portability, opt out of certain sales/sharing/targeted advertising, limit certain uses of sensitive information, appeal certain privacy decisions, and receive information about privacy practices.

34 California Privacy Rights

California residents may have rights under the CCPA, as amended by the CPRA, subject to applicable definitions and exemptions, including rights to know, access, correct, delete, obtain portability, opt out of sale or sharing where applicable, limit certain uses/disclosures of sensitive personal information where applicable, and exercise rights without unlawful discrimination.

35 Other State Privacy Rights

Residents of other states may have additional privacy rights. CALiNGA may issue supplemental privacy notices or state-specific disclosures as laws become applicable to CALiNGA’s operations.

36 Consumer Health Data

Certain states may regulate consumer health data separately from general personal information. Because CALiNGA facilitates care-related services, some information could fall within such definitions. Where applicable, CALiNGA will provide required disclosures, consent mechanisms, access/deletion rights, and other protections and may publish a separate Consumer Health Data Privacy Notice.

37 Privacy Requests

Privacy requests may be submitted through available account settings or to privacy@calingacare.com. CALiNGA may verify identity. Authorized agents may submit requests where permitted and subject to verification. CALiNGA will respond within legally required periods and provide appeal instructions where required.

38 Communication Choices

Users may manage certain email, SMS, push-notification, and marketing preferences. Users may continue receiving transactional or service-related communications necessary for account, booking, payment, security, or legal purposes.

39 Location Choices

Users may manage device location permissions through mobile-device settings. Certain functions, including location-based matching or geofenced clock-in/out, may not operate correctly if location access is disabled.

40 Children and Minors

Standard CALiNGA accounts are intended for adults age 18 or older unless CALiNGA expressly provides another legally compliant service. CALiNGA does not knowingly permit children under 18 to independently create standard accounts. Information concerning a minor may be provided by an appropriately authorized adult when reasonably necessary to arrange lawful care services.

42 International Access

CALiNGA is operated from the United States. If users access the Platform from outside the United States, information may be processed in the United States or other jurisdictions where service providers operate, subject to applicable law. Availability outside the United States does not necessarily mean CALiNGA offers services there.

43 Changes to This Privacy Policy

CALiNGA may update this Privacy Policy as its Platform, technology, features, business practices, geographic availability, or legal obligations change. The Last Updated date identifies the current version. For material changes, CALiNGA may provide notice through the Platform, email, website, or another reasonable method and may request renewed consent or acknowledgment where required.

44 Future State-Specific Notices

CALiNGA may publish additional state-specific privacy disclosures addressing privacy, sensitive information, consumer health data, biometric information, location information, or other matters regulated by a particular jurisdiction. Such notices should be read together with this Policy.

46 Privacy Policy and Terms Acceptance

Use of the CALiNGA Platform is subject to the CALiNGA Terms of Service and this Privacy Policy. Where CALiNGA presents an electronic acceptance mechanism, CALiNGA may record information reasonably necessary to document acceptance or acknowledgment of applicable versions. Material updates may require renewed acknowledgment or consent where required or appropriate.
